Expert Witness

The most important aspects of being a great Expert Witness are:

  • One needs to have the right type experience vs. just having experience; there is a big difference in the two.

  • Having the depth and breath of knowledge is powerful and is critical.

  • Able to “effectively” communicate subject matter knowledge to others. Simply having the knowledge does NOT mean one can effectively communicate that knowledge to others, especially lay persons.

  • Litigation is a team sport that takes practice, preparation, and incorporating corrective suggestions from others all to be used as part of a larger game plan and approach.

  • Able to withstand being challenged (cross-examination), remain confident, consistent, assertive, while demonstrating respect, professionalism, and objectivity.

  • Able to assess and deliver the relative mertis of a opinion and position in a direct, transparent, and open manner; even possibly calling out what others are thinking but no one is saying.

Choosing an expert witness is both art and science.

Some might possess some experience or knowledge along with some possible combination of other facets described above, but few will possess and execute well on all.

You will find Scott possesses all of these important qualities for being a great Expert Witness, with just the right balance.

In addition to his education and experience, some areas which make Scott a great expert witness are the fact he believes:

  • Our attitude is a choice we make, not something forced on us externally.

  • Letting hard work, accountability, contractual obligations, reasonable expectations, and best practices guide actions during a design and construction project.

  • In a direct approach and in making the complex simple.

  • Rarely is it 100% one parties fault and 0% the other. Starting with that approach often creates a better environment for solving problems..

  • The single biggest success factor in disputes is making the complex simple and being able to help others see and understand what you see and understand.
